Terms And Conditions
  1. To qualify for this program you must meet the following conditions:
    1. You must live in a residential property that has an authorised or approved connection to a watermain owned by SE Water (South East Water).
    2. If you are a tenant, you must have your Landlord's written permission to have this service completed at the property.
    3. You must be replacing an existing, functioning single flush or dual flush toilet suite.
    4. You must have the new WELS 4-star water rated toilet suite(s) installed by the designated SE Water contractor.
  2. SE Water's offer:
    1. SE Water's designated contractor who is a qualified plumber will
      1. Replace an existing single flush toilet with a WELS 4-star rated toilet suite. The entire suite (pan and cistern) will be replaced. You may choose one of three toilet suites offered. Each toilet suite is priced differently, refer to Clause 4.
      2. Provide you with details of the work done at your property.
  3. What you need to do to accept the offer:
    1. Make an appointment with the Contractor/SE Water by phoning the designated number or registering at www.dualflush.com.au/sew
    2. Sign the invoice and Terms and Conditions that will be provided to you by the plumber during his/her visit.
    3. Pay any relevant charges as outlined in Clause 4.
  4. What you have to pay and give to SE Water (or their nominated Contractor):
    1. The Contractor will invoice you directly for the cost of the new toilet. The full cost will have the $100 Water Smart Gardens and Homes dual flush toilet rebate applied to it, and this will be reflected in the invoice.
    2. You do not need to apply for the Victorian Government rebate as SE Water will apply the rebate on your behalf as part of this program. The Water Smart Gardens and Homes rebate of $100 is being applied and will be reflected in the final price of the toilet suite you select. You are entitled to only one Water Smart Gardens and Homes dual flush toilet rebate per property.
    3. The Service Fee (product, installation and GST inclusive) is as follows:
      1. Toilet Suite 1 - Caroma Stylus Symphony Toilet Suite in white at a full price of $384 (discounted price of $284 after applying the rebate).
      2. Toilet Suite 2 - Caroma Concorde Profile Toilet Suite in white at a full price of $527 (discounted price of $427 after applying the rebate).
      3. Toilet Suite 3 - Caroma Caravelle Toilet Suite in white at a full price of $613 (discounted price of $513 after applying the rebate).
    4. Additional toilets will not attract the Water Smart Gardens and Homes dual flush toilet rebate and will be charged accordingly.
    5. If the Contractor performs any additional works while onsite these will also appear on the invoice.
    6. The total amount to be paid will be shown as a service fee being comprised of toilet purchase, installation and other works, less the rebate and subsidy.
  5. Payment of the Service Fee:
    1. The Contractor, on behalf of SE Water will invoice you for the Service Fee. The Service Fee will be payable upon completion of the works.
    2. Payment can be made by cash, credit card, EFT or cheque.
    3. If you fail to pay by the due date we may send you reminder notices. If you fail to pay or make alternative arrangements to pay we may add the Service Fee to your next SE Water account.
    4. You agree that it is your responsibility to pay all service charges should you change your mind after the installation has commenced.
    5. The Victorian Government Water Smart Gardens and Homes dual flush toilet rebate is limited to one per household. Should it be found that the property has already received a dual flush toilet rebate, the rebate amount ($100) will be added to your next SE Water account.
  6. Further limitations:
    1. Nothing in this agreement will be taken to affect any statutory obligation that we have to you for any condition or warranty implied by the Trade Practices Act. In the event we are liable for any breach of such a warranty or condition, then to the extent that we are able to do so we limit our liability to you:
      1. in the case of goods, any one or more of the repair or replacement of the goods or the cost of having them replaced; or?
      2. in the case of services, the supply of the services again or the payment of the cost of having the services supplied again.
    2. Products installed will be covered by a 10 year manufacturer's warranty, which commences from the date of installation.
    3. The position of your waste outlet pipe and water inlet tap must be compatible with the selected models on offer.
    4. Subject to Clause 9 this offer remains open for acceptance until 31 August 2010.
  7. Warranty
    1. The manufacturer warrants its products against defects in materials under normal use and service for a period of 10 years from the date of installation. The warranty is limited to one or more of the following:
      1. replacement of the goods or supply of equivalent goods;
      2. repair of the goods;
      3. payment of reasonable costs of having the goods repaired.
    2. There is a seven year workmanship warranty on the toilet installation, which commences from the date of installation.
    3. Further details on product and workmanship warranties can found on the warranty cards supplied at installation.
  8. Acknowledgment:
    You acknowledge that the services offered by SE Water as part of this offer are not offered to you as a 'customer' as that term is defined in the SE Water Customer Contract. A copy of the Customer Contract is available at www.southeastwater.com.au.
  9. Program changes and early termination:
    SE Water reserves the right, at its sole and absolute discretion and at any time, to change any or all of the terms and conditions for the Program or to cancel the Program prior to 31 August 2011.
  10. Privacy Notice:
    SE Water will collect, use and disclose the personal information You provide for the purposes You have provided it to them. This information may be provided to the contractor appointed by SE Water and the Plumber who carries out the service. To ensure the protection of information contractors are required by SE Water to comply with the requirements of the Privacy Act 1988(Cth).
  11. Inspection of Services by SE Water
    SE Water may inspect the Residence to ensure that the Services have been completed. The inspection may be carried out within 6 months after the completion of the Services. The inspection will be carried out between 8am and 6pm on a day agreed between you and SE Water. You and SE Water must act reasonably in relation to the inspection.
  12. Collation of Information and Research
    You agree to allow any information collected by the Plumber or SE Water concerning You and water consumption at the Residence before, during or after the carrying out of the Service to be used for the purposes of providing services to You and for all other purposes connected with the supply of water and ancillary services by SE Water.
    You agree that SE Water may contact you and that you will provide to SE Water any information it reasonably requests relating to the Service or water consumption and ancillary services at the Residence.
  13. Green house Gas abatement Certificates:
    You acknowledge that SE Water claim and sell the greenhouse credits should a trading scheme in Victoria commence. You nominate SE Water as the greenhouse "Abator" in respect of SE Water Water Conservation Programs.
    1. Nomination entitles SE Water to create and own all abatement certificates in respect of the showerhead(s) you receive under the program, regardless of when the greenhouse gas abatement occurs.
    2. You declare you are solely liable to pay for the gas, electricity and water used at the address nominated on this form; or
    3. Nomination entitles SE Water to create and own all abatement certificates in respect of the water efficient appliance(s) you receive under the program, regardless of when the greenhouse gas abatement occurs.
    4. You have not previously made another nomination in respect of SE Water's toilet replacement program or showerhead replacement program; and
    5. No one else has made a nomination in respect of this address.
    6. You declare that the appliance(s) will be installed at the address listed, and that any 3 Star rated showerhead(s) obtained will be replacing a non-3 Star rated showerhead(s).
    7. By choosing to exchange your showerhead as part of this program, you will not be able to get back your original showerhead once exchanged.
    8. 3 star rated showerheads are not compatible with gravity fed or some instantaneous hot water systems.
    9. SE Water may choose to contact you to promote your participation in this program.
  14. Definitions:
    In these Terms and Conditions:
    1. Plumber means a licensed Plumber who have been employed or engaged by Schultz Plumbing ABN 73 662 981 120 on behalf of SE Water to provide the Services.
    2. Rebate means the $100 Dual Flush Toilet Rebate payable by the Victorian Government under the Victorian Government's Water Smart Gardens and Homes Rebate Scheme. This rebate is subject to change at the discretion of the State Government.
    3. Property means the address identified in this form and which You warrant has an authorised connection to the Supply System.
    4. Services means:
      1. the supply and installation of a 4 star-rated dual flush toilet.
      2. the removal of the old single flush toilet as part of the Services.
      3. a reasonable demonstration and explanation of the goods installed.
    5. SE Water means South East Water Limited.
    6. Offer means the provision of SE Water's subsidised water saving service as part of its Toilet Replacement Service.
    7. Program means SE Water's Toilet Replacement Service.
    8. Service Fee means the invoiced fee for the services undertaken as per Clause 4c of this Agreement.
    9. We means SE Water Limited, its employees and contractors.
    10. You means the person who signs these Terms when the service is carried out at the property. You also have any authority required by these terms and conditions before signing, which means the authority of the landlord if you are a tenant. This agreement is not part of the SE Water Customer Contract.
    11. Standard installation means installations that include one or more of the following:
      1. Straight-forward removal and replacement
      2. Installation in two or less storey unit/house.
    12. Non-standard installation means installations that require one or more of the following:
      1. Modification to existing waste or water point connections
      2. Removal of tiles required due to base of toilet being tiled over
      3. Existing toilet pan built up above floor level on a concrete base
      4. Toilet installation is on third floor and above
      5. Skew/side delivery pan required
      6. Pan collar waste pipe needs replacement or rubber has perished
      7. Restoration works to floor or wall due to new install not matching previous installation footprint of cistern and pan
      8. Poor condition of floor levels or floor boards
      9. Disabled installation
      10. Installation outside nominated working hours (e.g. after 9pm or Sundays)
      11. Toilet model request outside of range on offer
      12. Installation of a mid level model (required where the water point is too high for a standard model
      13. Rectification or alteration due to poor or illegal previous plumbing works
      14. Installation of second or more toilet suites as rebate and subsidy will not apply.
