To qualify for this program you must meet the following conditions:
You must be a residential customer of South East Water.
If you are a tenant, you must have your Landlord's written permission to have this service completed at the property.
You must be replacing an existing, functioning single flush toilet suite and or non-WELS 4-star rated dual flush toilet-.
You must have the new WELS 4-star water rated toilet suite(s) installed by the Designated Contractor.

South East Water's Designated Contractor:
Replace an existing single flush toilet and or non-WELS 4-star rated dual flush toilets with a WELS 4-star rated toilet suite. The entire suite (pan and cistern) will be replaced. You may choose one of four toilet suites offered. Each toilet suite is priced differently, refer to Clause 4.
Provide you with details of the work done at your property.
What you need to do to accept the offer:
Make an appointment with the Designated Contractor by phoning the designated number or registering at www.dualflush.com.au/sew.
Sign the receipt that will be provided to you by the plumber during his/her visit.
Pay any relevant charges as outlined in Clause 4 on the day of works.
What you have to pay and give to South East Water (or their Designated Contractor):
The Designated Contractor will invoice you directly for the cost of the new toilet. The full cost will have the $100 Living Victoria Water Rebate (formerly known as the Victorian Government Water Smart Gardens & Homes Rebate Scheme) dual flush toilet rebate reflected in the invoice.
You do not need to apply for the Living Victoria Water Rebate as South East Water will apply for the rebate on your behalf as part of this program. The $100 Living Victoria Water Rebate is being applied and will be reflected in the final price of the toilet suite you select
You are entitled to only one Living Victoria Water Rebate or equivalent Water Smart Gardens & Homes dual flush toilet rebate
The Service Fee (product, installation and GST inclusive) is as follows:
Toilet Suite 1 - Caroma Stylus Symphony Toilet Suite in white at a full price of $384 (discounted price of $284 after applying the rebate and subsidy).
Toilet Suite 2 - Caroma Concorde Profile Toilet Suite in white at a full price of $527 (discounted price of $427 after applying the rebate and subsidy).
Toilet Suite 3 - Caroma Caravelle Toilet Suite in white at a full price of $613 (discounted price of $513 after applying the rebate).
Toilet Suite 4 - Caroma Profile 5 Toilet Suite in white at a full price of $799 (discounted price of $699 after applying the rebate).
Additional toilets will not attract the Living Victoria Water Rebate dual flush toilet rebate and will be charged accordingly.
If the Designated Contractor performs, any additional works while onsite these will also appear on the invoice.
The total amount to be paid will be shown as a service fee being comprised of toilet purchase, installation and other works, less the rebate.
Payment of the Service Fee:
The Designated Contractor, on behalf of South East Water will invoice you for the Service Fee. The Service Fee will be payable upon completion of the works.
Payment can be made by cash, credit card, EFT or cheque.
You agree that it is your responsibility to pay all service charges should you change your mind after the installation has commenced.
The Living Victoria Water Rebate dual flush toilet rebate is limited to one per household. Should it be found that the property has already received a dual flush toilet rebate or subsidy, the rebated amount ($100) will be added to your next South East Water account
Audit and inspection: As a publicly owned utility, South East Water may need to check that the work has been completed and was done to a satisfactory standard. You give your consent to South East Water carrying out an inspection of your property for these purposes, provided it is within 12 months of the service being completed. You will cooperate with South East Water and give its representative access to your property for purposes of an inspection between 8am-6pm on the preferred day and mutually agreed time.
Further limitations:
Nothing in this agreement will be taken to affect any statutory obligation that we have to you for any condition or warranty implied by the Trade Practices Act. In the event we are liable for any breach of such a warranty or condition, then to the extent that we are able to do so we limit our liability to you:
in the case of goods, any one or more of the repair or replacement of the goods or the cost of having them replaced; or
in the case of services, the supply of the services again or the payment of the cost of having the services supplied again.
Products installed will be covered by a 10 year manufacturer's warranty, which commences from the date of installation.
The position of your waste outlet pipe and water inlet tap must be compatible with the selected models on offer.
Subject to Clause 10 this offer remains open for acceptance until 30th June 2013
Warranty
The manufacturer warrants its products against defects in materials under normal use and service for a period of 10 years from the date of installation. The warranty is limited to one or more of the following:
replacement of the goods or supply of equivalent goods;
repair of the goods;
payment of reasonable costs of having the goods repaired.
The manufacturer's warranty on cisterns is voided if water additives are used in the cistern.
There is a seven year workmanship warranty on the toilet installation, which commences from the date of installation.
Acknowledgment: You acknowledge that the services offered by South East Water as part of this offer are not offered to you as a 'customer' as that term is defined in the South East Water Customer Contract. A copy of the Customer Contract is available at www.southeastwater.com.au.
Program changes and early termination: South East Water reserves the right, at its sole and absolute discretion and at any time, to change any or all of the terms and conditions for the Program or to cancel the Program.
Privacy Notice: South East Water will collect, use and disclose the personal information You provide for the purposes You have provided it to them. This information may be provided to the Designated Contractor appointed by South East Water and the Plumber who carries out the service. To ensure the protection of information contractors are required by South East Water to comply with the requirements of the Privacy Act 1988(Cth).
Collation of Information and Research You agree to allow any information collected by the Plumber or South East Water concerning You and water consumption at the Residence before, during or after the carrying out of the Service to be used for the purposes of providing services to You and for all other purposes connected with the supply of water and ancillary services by South East Water. You agree that South East Water may contact you and that you will provide to South East Water any information it reasonably requests relating to the Service or water consumption and ancillary services at the Residence.
Green house Gas abatement Certificates: You acknowledge that South East Water claim and sell the greenhouse credits should a trading scheme in Victoria commence. You nominate South East Water as the greenhouse "Abator" in respect of South East Water Water Efficiency Programs.
Nomination entitles South East Water to create and own all abatement certificates in respect of the showerhead(s) you receive under the program, regardless of when the greenhouse gas abatement occurs.
You declare you are solely liable to pay for the gas, electricity and water used at the address nominated on this form; or
Nomination entitles South East Water to create and own all abatement certificates in respect of the water efficient appliance(s) you receive under the program, regardless of when the greenhouse gas abatement occurs.
You have not previously made another nomination in respect of South East Water's toilet retrofit program or showerhead exchange program; and
No one else has made a nomination in respect of this address.
You declare that the appliance(s) will be installed at the address listed, and that any 3 Star rated showerhead(s) obtained will be replacing a non-3 Star rated showerhead(s).
By choosing to exchange your showerhead as part of this program, you will not be able to get back your original showerhead once exchanged.
3 star rated showerheads are not compatible with gravity fed or some instantaneous hot water systems.
South East Water may choose to contact you to promote your participation in this program.
Definitions: In these Terms and Conditions:
Designated Contractor means the contractor South East Water nominates to perform the plumbing retrofit works (who will be or employs qualified plumbers to perform these works.
Plumber means a licensed Plumber who have been employed or engaged by the Designated Contractor
Rebate means the $100 Dual Flush Toilet Rebate payable by the Victorian Government under the Living Victoria Water Rebate (formerly known as the Victorian Government Water Smart Gardens & Homes Rebate Scheme). This offer is available for a limited time.
Property means the address identified in this form and which You warrant has an authorised connection to the Supply System.
Services means:
the supply and installation of a 4 star-rated dual flush toilet.
the removal of the old single flush toilet and non-WELS 4-star rated dual flush toilet as part of the Services.
a reasonable demonstration and explanation of the goods installed.
South East Water means South East Water Limited.
Offer means the provision of South East Water's subsidised water saving service as part of its Toilet Replacement Program.
Program means South East Water's Toilet Replacement Program.
Service Fee means the invoiced fee for the services undertaken as per Clause 4c of this Agreement.
Subsidy: means the $50 South East Water subsidy payable by the South East Water Limited. This offer is available for the first 2000 toilets and for a limited time.
We means South East Water Limited, its employees and contractors.
You means the person who signs these Terms when the service is carried out at the property. You also have any authority required by these terms and conditions before signing, which means the authority of the landlord if you are a tenant. This agreement is not part of the South East Water Customer Contract.
Standard installation means installations that include one or more of the following:
Modification to existing waste or water point connections not required
Straight-forward removal and replacement
Installation in two or less storey unit/house
Basic pan collar rubber
Type 6 pan collar rubber
Extended flush pipe kit
Non-standard installation means installations that require one or more of the following:
Removal of tiles required due to base of toilet being tiled over
Existing toilet pan built up above floor level on a concrete base
Toilet installation is on third floor and above
Skew/side delivery pan required
Restoration works to floor or wall due to new install not matching previous installation footprint of cistern and pan
Poor condition of floor levels or floor boards
Disabled installation
Installation outside nominated working hours (e.g. after 9pm or Sundays)
Toilet model request outside of range on offer
Installation of a mid level model (required where the water point is too high for a standard model
Rectification or alteration due to poor or illegal previous plumbing works
Installation of second or more toilet suites as rebate will not apply
