
- To qualify for this program you must meet the following conditions:
- You must live in a residential property that is connected to a reticulated water supply serviced by Yarra Valley Water.
- If you are a tenant, you must have your Landlord's written permission to have this Service completed at the property in accordance with the requirements of the Residential Tenancies Act 1997 (Vic).
- You must be replacing an existing, functioning single flush toilet suite.
- You must have the selected WELS 4-star water rated toilet suite(s) installed by the designated Yarra Valley Water Plumber.
- Yarra Valley Water's offer:
- Yarra Valley Water's designated Plumber who is a licensed plumber will:
- Replace an existing single flush toilet with a WELS 4-star rated toilet suite. The entire suite (pan and cistern) will be replaced. You may choose one of three toilet suites offered. Each toilet suite is priced differently, refer to Clause 4.
- Provide you with details of the work performed at your property.
- What you need to do to accept the offer:
- Make an appointment with the Contractor/Yarra Valley Water by phoning the designated phone number 1300 2 FLUSH or by registering on the website www.dualflush.com.au/yvw
- Agree to and sign these terms and conditions.
- Sign the receipt that will be provided to you by the plumber during his/her visit.
- Pay any relevant charges as outlined in Clause 4.
- What you have to pay Yarra Valley Water (or their nominated Contractor):
- The Contractor will invoice you directly for the Service Fee, which will include the cost of the new toilet and its installation. The full cost will have the Victorian Government's $100 Water Smart Gardens and Homes Dual Flush Toilet Rebate applied to it, and this will be reflected in the invoice. You do not need to apply for the Rebate.
- Each household is entitled to only one Water Smart Gardens and Homes Dual Flush Toilet Rebate.
- The Service Fee for a Standard Installation is as follows (GST inclusive):
- Toilet Suite 1 - Stylus Symphony Toilet Suite in white at a full price of $384 (discounted price of $284 after applying the rebate).
- Toilet Suite 2 - Concorde Profile Toilet Suite in white at a full price of $527 (discounted price of $427 after applying the rebate).
- Toilet Suite 3 - Caravelle Toilet Suite in white at a full price of $613 (discounted price of $513 after applying the rebate).
- Non-Standard Installations may incur a higher Service Fee reflecting any additional costs involved in the installation.
- Additional toilets will not attract the Water Smart Gardens and Homes Dual Flush Toilet Rebate and will be charged accordingly.
- If the Plumber performs any other works not related to the installation of the toilet suite(s) while onsite these will also appear on the invoice.
- Payment of the Service Fee:
- The Service Fee will be payable upon completion of the Services.
- Payment can be made by cash, credit card, EFT or cheque.
- If you fail to pay by the due date we may send you reminder notices. If you fail to pay or make alternative arrangements to pay, We may add the Service Fee to your next Yarra Valley Water account.
- You agree that it is your responsibility to pay all service charges should you change your mind after the installation has commenced.
- The Victorian Government Water Smart Gardens and Homes dual flush toilet rebate is limited to one per household. Should it be found that the property has already received a dual flush toilet rebate, the rebate amount ($100) will be added to your next Yarra Valley Water account.
- Further limitations:
- In the event We are liable for any breach of these terms and conditions or a statutory warranty or condition, then to the extent that We are able to do so We limit our liability to You:
- in the case of goods, to any one or more of the repair or replacement of the goods or the cost of having them replaced; or
- in the case of services, to the supply of the services again or the payment of the cost of having the services supplied again.
- The offer contained in these terms and conditions is conditional on the position of your waste outlet pipe and water inlet tap being compatible with one of the selected Toilet Suites on offer.
- Subject to Clause 9 this offer remains open for acceptance until 31 August 2010.
- This program is only available whilst stocks last.
- Warranty:
- The manufacturer warrants its products against defects in materials under normal use and service for a period of 10 years from the date of installation. The warranty is limited to one or more of the following:
- replacement of the goods or supply of equivalent goods;
- repair of the goods;
- payment of reasonable costs of having the goods repaired.
- The manufacturer's warranty on cisterns is voided if water additives are used in the cistern.
- We assign to You the benefits of the manufacturer's warranty.
- The Contractor provides a seven year workmanship warranty on the toilet installation, which commences from the date of installation.
- Acknowledgment:
You acknowledge that the services offered by Yarra Valley Water as part of this offer are not offered to you as a 'customer' as that term is defined in the Yarra Valley Water Customer Contract. A copy of the Customer Contract is available at www.yvw.com.au. - Program changes and early termination:
Yarra Valley Water reserves the right, at its sole and absolute discretion and at any time, to change any or all of the terms and conditions for the Program or to cancel the Program prior to 31 August 2010. - Information and Privacy Notice:
You agree to allow Yarra Valley Water to contact you and that you will provide Yarra Valley Water, the Contractor or the Plumber with any information it reasonably requests relating to the Services, water consumption and ancillary services at the Property. Any information collected by Yarra Valley Water, the Contractor or Plumber for these purposes will only be used for the purposes of providing services to You and for all other purposes connected with the supply of water and ancillary services by Yarra Valley Water. To ensure the protection of information the Contractor and Plumber are required by Yarra Valley Water to comply with the requirements of the Privacy Act 1988(Cth). - Inspection of Services by Yarra Valley Water:
Yarra Valley Water may inspect the Property to ensure that the Services have been completed and that the work was satisfactory. The inspection may be carried out within 12 months after the completion of the Services. The inspection will be carried out between 8 am and 6 pm on a day agreed between you and Yarra Valley Water. You will cooperate with Yarra Valley Water and give its representative access to your property for the purposes of the inspection. - Add on Services:
As part of this Program the Contractor can also: - provide and install for free one (1) 3 star rated water efficient showerhead on exchange for a less water efficient showerhead and one (1) flow control valve.
- conduct a home water audit that complies with the Victorian Government's Water Smart Gardens and Homes Water Conservation Audit Rebate.
In rental situations, both the landlord and tenant must agree to the replacement of the existing showerhead with the water efficient showerhead and the installation of the flow control valve in accordance with the Residential Tenancies Act 1997 (Vic). Yarra Valley Water is not responsible for any damage caused as a result of the installations. Water efficient showerheads are not suitable for low pressure, gravity fed (in the roof) and some instantaneous or continuous supply hot water systems. Only chrome models are available. The Recommended Retail Price for the showerheads on offer is over $30.00. Yarra Valley Water takes no responsibility for plumbing issues relating to your property as a result of the installations of these products. By choosing to exchange your showerhead as part of this program, you will not be able to get back your original showerhead once exchanged. - Greenhouse Gas Abatement Certificates:
You acknowledge that Yarra Valley Water can claim and sell any greenhouse credits that arise from this offer should an emissions abatement or trading or any similar scheme commence in Victoria. You nominate Yarra Valley Water as the greenhouse "Abator" in respect of Yarra Valley Water Water Conservation Programs. - You declare you are solely liable to pay for the gas, electricity and water used at the address nominated on this form; or
- Nomination entitles Yarra Valley Water to create and own all abatement certificates in respect of the water efficient appliance(s) (for the avoidance of doubt these include the toilet suite(s), showerhead and flow control valve) you receive under the program, regardless of when the greenhouse gas abatement occurs.
- You have not previously made another nomination in respect of Yarra Valley Water Toilet Replacement Program or Showerhead Exchange Program; and
- No one else has made a nomination in respect of this Property.
- You declare that the appliance(s) will be installed at the address listed, and that any 3 star rated showerhead(s) obtained will be replacing a non-3 star rated showerhead(s).
- Yarra Valley Water may choose to contact you to promote your participation in this program.
- Definitions:
In these Terms and Conditions:- Plumber means a licensed Plumber who has been employed or engaged by Schultz Plumbing ABN 73 662 981 120 on behalf of Yarra Valley Water to provide the Services.
- Contractor means Schultz Plumbing ABN 73 662 981 120.
- Rebate means the $50 Dual Flush Toilet Rebate payable by the Victorian Government under the Victorian Government's Water Smart Gardens and Homes Rebate Scheme.
- Property means the address identified in this form and which You warrant has an authorised connection to a reticulated water supply serviced by Yarra Valley Water.
- Services means:
- the supply and installation of a WELS 4 star rated dual flush toilet suite.
- the removal of the old single flush toilet as part of the Services.
- a reasonable demonstration and explanation of the toilet suite installed.
- Offer means the offer contained in these terms and conditions.
- Program means Yarra Valley Water's Toilet Replacement Program.
- Service Fee means the invoiced fee for the services undertaken as per Clause 4c of this Agreement.
- We means Yarra Valley Water Corporation, its employees and contractors.
- WELS 4 star toilet suite means a toilet suite given a rating of four stars under the Water Efficiency Labelling and Standards Scheme.
- You means the person who signs these terms and conditions when the Service is carried out at the Property. You also have any authority required by these terms and conditions before signing, which means the agreement of the landlord if you are a tenant.
- Standard installation means an installation that requires:
- No modification to existing waste or water point connections.
- Removal and replacement only.
- Installation in a two or less storey unit/house.
- Non-standard installation means any other installation of a toilet suite under this Program. For the avoidance of doubt these include installations that require one or more of the following:
- Modification to the waste or water pipe height;
- Removal of tiles required due to base of toilet being tiled over;
- Existing toilet pan built up above floor level on a concrete base;
- Toilet installation is on third floor and above;
- Skew/side delivery pan required;
- Pan collar waste pipe needs replacement or rubber has perished;
- Restoration works to floor or wall due to new install not matching previous installation footprint of cistern and pan;
- Poor condition of floor levels or floor boards;
- Disabled installation;
- Installation outside nominated working hours (e.g. after 9pm or Sunday);
- Toilet model requested outside range on offer;
- Installation of a mid level model (required where the water point is too high for a standard model);
- Rectification or alteration due to poor or illegal previous plumbing works;
- Installation of second or more toilet suits as rebate will not apply.
